TERMS
“I, Me” means the practitioner, Belinda Rennie.
“You, Your” means patient
“Product” means the Oragene DNA saliva test or any other similar saliva test that smartDNA may use from time to time.
“Report” means the nutritional genomic or microbiome report provided to You based on the sample provided.
“Request Form” means the request form properly completed and signed by You and provided to smartDNA together with the Sample
“Sample” means the saliva or stool sample provided by You as collected in accordance with the directions set out in the instruction sheet contained in the Product;
PRIVACY STATEMENT
SmartDNA in conjunction with the practitioner, Belinda Rennie are committed to protecting Your privacy. All Reports and any personal information are maintained under a strict policy of confidentiality as set out below.
PATIENT CONFIDENTIALITY
Personal information will not be disclosed to any person except as required in using the Product for the specific purpose of producing the Report. When You purchase the Product, there is a set of terms and conditions set out below which are designed to ensure that you receive the best possible service.
REPORT
The Report is intended for Me to hold on file for You and is released to You after the Interpretation session or at another time at My sole discretion.
Any information that I provide to You in relation to the Report with be given within the context of Your medical and family history as I know it.
You agree to indemnify Me from and against all actions, suits, claims, demands, liabilities, costs, expenses, loss and damage (including legal fees on a full indemnity basis) incurred, suffered or arising out of or in connection with the Report whatsoever, including but not limited to any action You may take.
QUALITY CONTROL
Any Sample which does not for any reason whatsoever provide smartDNA with sufficient data to enable them to prepare a Report will be deemed to be a Failed Sample. Subject to the nature of the Failed Sample, smartDNA may request that You provide another Sample. Notwithstanding anything, smartDNA reserve the unfettered right to reject a Sample for any reason whatsoever in which case they will provide You with a full refund for the cost of the Product.
USE AND DISPOSAL OF THE PATIENT’S SAMPLE
A Sample will be used solely for the purpose of producing the Report by smartDNA as requested by You. Once smartDNA have completed the testing required to produce the Report they will destroy the Sample. You acknowledge and agree that once You provide the Sample to smartDNA it becomes their property and neither You nor I may request the return of the Sample for any reason whatsoever.
PERFORMANCE OF SERVICE
In order for smartDNA to perform the testing, I send the Sample (unless it is mailed to you) together with a properly completed Request Form to smartDNA which includes Your acknowledgement. Upon receipt of the Sample and accompanying properly completed Request Form smartDNA agree to perform the specified gene analysis testing service on that Sample as required by them for the specific purpose of preparing the Report.
SAMPLE COLLECTION
Each Product has a unique identifier. This unique identifier must be transcribed by me on to the Request Form and verified in the form of a date and signature at the bottom of the form. In addition, Your name and date of birth must be transcribed onto the side of the collection device. SmartDNA take no responsibility for the misuse of the Product or an inadequate Sample quality. SmartDNA will notify me if a Sample does not yield an adequate result as determined by their quality control procedures. It is my responsibility to send the sample to smartDNA unless the product is requested by You by mail. Once the Sample has been collected and the Request Form completed, they are forwarded to SMART DNA Pty Ltd, PO Box 4156, McKinnon, Victoria 3204
NO MEDICAL ADVICE OR GUARANTEES
This testing is non-medical and cannot diagnose disease and the information provided to You in the Report does not confirm or replace any medical diagnosis.
The information contained in the Report relating to the Sample will provide an assessment of Your genetic predisposition required for the testing provided by smartDNA. This is based on a particular genetic test and underlying statistical analyses as assessed by a molecular geneticist. This information is not a confirmation that You will or will not develop a particular medical condition, nor does it provide any indication of the timing at which this may occur (if at all). The information provided to You in the Report is not a genetic diagnosis of disease, nor does it identify existing medical conditions. We do not measure every possible genetic variation. You may have additional risk factors that are not measured by the testing. Negative findings do not imply that You are risk free. This testing does not provide evidence of food allergies and it does not test for specific food allergies. Recommendation options following the testing are based on your health and family history that you have shared with me.
Supplementary reports will not be issued if new information becomes available as Your sample is destroyed after testing.
